I - Preamble
The contact details of the teachers are never sent to the students except in the case where the teacher accepts the lesson requests and indicates that they want to send their contact details to the student to organize the first lesson.
All the pages of the site are secured by the HTTPS protocol and the navigation between the pages is encrypted.
No bank card data is ever kept by Superprof, apart from the last 4 digits.
Superprof does not sell or rent any information or data about its members.
After consulting the tutoring adverts, students can get in touch with teachers they have selected.
They then send a lesson request containing a message to all teachers who seem to match their request. These messages must not contain any means of contacting the student other than through the Superprof site, i.e. neither a telephone number, nor a URL, nor an email or postal address.
Connecting with one of the selected teachers will cost the student $0/month (Student Pass) and its costs will give them the possibility of contacting as many teachers as they wish during their subscription. The subscription is automatically renewable and without obligation.
The student can cancel their $0/month subscription at any time from their account.
If several of the teachers selected are available, the student will only pay the price of the Student Pass of $0 once a month and can thus choose the teacher they prefer.
The student can only be reimbursed in the event of the teacher's unavailability. Depending on the case, proof may be requested in order to proceed with the reimbursement. We would like to point out that if the request for reimbursement in the event of the teacher's unavailability is accepted, the deactivation of the Student Pass remains the responsibility of the member, who is invited to follow the termination procedure to interrupt the renewal of the service fees.
If the lesson request is initially accepted and then declined for ethical and legally sanctioned reasons (such as the explicit request to substitute the student during an exam or complete writing of assignments), Superprof will not respond favourably upon request for reimbursement.
As a Tutor on Superprof :
You acknowledge that it is not authorised to engage in any activity which constitutes or facilitates cheating or plagiarism by a student.
As a student on Superprof :
You acknowledge that it is not authorised to enquire about the engagement of or to engage tutors to complete assignments, write papers, take quizzes or otherwise do work on your behalf. In addition, you agree not to use Superprof for any reason that violates the academic honesty policy or other conduct policies of your school, university, academic institution, or workplace.
All new tutors to the platform are required to offer students a free first session, which will be communicated explicitly in their adverts (« 1st lesson free »). Failure to respect this policy may lead to your advert being temporarily suspended or removed indefinitely from the platform.
The duration of this free session will be set at 1 hour by default but can be modified. The session must be at least 30 minutes and the specifics of what is included in the free session should be laid out clearly to students before booking the class.
Only tutors who have reached at least Super Tutor status can opt out of this policy. This requires at least 4 recommendations and 1 review, an uploaded diploma/qualification, and a response time of fewer than 24 hours.
II - Privacy Policy
1. General
Superprof (whose registered office is at 42-44 rue Alexandre Dumas, 75011, Paris, France ) (“Superprof”, “we”, “our” or “us”), acting as data controller, is committed to protecting and respecting your privacy. This notice (the “Privacy Notice”) is designed to tell you about our practices regarding the collection, use and disclosure of information that you may provide via this website or the “Platform“).
This Privacy Notice (together with our Terms and Conditions sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.
2. What information do we collect from you and for how long?
We may collect and process the following data about you:
2.1. The information you give us
You may give us information, including information that can identify you (“Personal Data“), when you use our Platforms, by filling in forms on the Platforms (such as the sign-up form), when you enter into any of our competitions, promotions or surveys, when you correspond with us by phone, e-mail or otherwise, and when you report a problem with our Platforms. Superprof is vigilant about the security of the members of the platform as well as information relating to the identity and means of payment of each of its members.If we notice a payment incident, a member of our team may contact you to verify your identity.
For the protection of your data, we use a Captcha service on our site. This service is deployed in order to verify entries on our site and to differentiate whether these are made by a human or automated robots. This measure allows you to use our site safely and to protect your account from spam. In order to benefit from this protection, an analysis is carried out and certain information is assigned (eg your IP address). Data processing is GDPR compliant. The information you give us may include:
2.1.1. Mandatory information required to register for the service we provide on our Platforms or to access other services provided by us, including your name, email address, date of birth, gender, mobile phone number, IP address, Skype / Hangouts ID and password are required. All these fields are mandatory. Superprof will not be able to provide you with the services offered on our Platforms if the required information is not provided, consequently, you will not be able to register for a user account on our Platforms
2.1.2. A photograph;
2.1.3. A postal address;
2.1.4. Details of your qualifications;
2.1.5. Your mini-portfolio;
2.1.6. A record of any correspondence between you and us;
2.1.7. A record of any requests you have made or related adverts you have placed with or through our Platforms;
2.1.8. Details of accounting or financial transactions including transactions carried out through our Platforms or otherwise. This may include information such as your payment card or bank account details, details of lessons that you have offered through our Platforms;
2.1.9. Details of your visits to our Platforms and the resources that you access;
2.1.10. Your replies to any surveys or questionnaires, such as your reviews on the lessons you have shared with other members of our community. Such information may be used for analytic & user understanding purposes;
2.1.11. Information we may require from you when you report a problem with our Platforms or our service, such as the subject of your request for support;
2.1.12. Location information when you have given consent to the collection and processing of this data;
2.1.13. Certificates and other documents that you have agreed to provide to us.
2.2. Information we collect automatically
2.2.1. If you sign up via social media authentication methods, Superprof will access certain Personal Data (e.g. first name, surname, picture, email, number of Facebook friends, etc.) in your social media account pursuant to the applicable terms and conditions of these social media platforms. We may also collect some of your Personal Data when you interact with third-party social media features, such as “Like” functions.
2.2.2. With regard to each of your visits to our Platforms we may collect, in accordance with applicable laws and where required with your consent, information relating to the devices you use and the networks you are connected to when using our services. This may include the following information: your IP address, log-in information, browser type and version, browser plug-in types and versions, operating system and platform, advertising identifier, information about your visit including the URL clickstream to, through and from our Platforms, products you viewed or searched for, download errors, length of visits to certain pages, page interaction and any phone number used to call our customer service number. We collect this information through the use of various technologies including cookies.
2.2.3. We also collect aggregated information regarding your activity on our Platform (such as the amount of lessons offered, your message response rate, etc.). Such information may be published on your public profile on our Platform.
2.3. Data retention
Your data will be retained and secured indefinitely unless you explicitly request the complete deletion of all your data. To do so, please send an email to hey@superprof.com titled Data Deletion.
3. How do we use the data we collect?
3.1 Perform contracts between you and us or between us and our business partners and provide you with requested information and services. This processing is necessary for the performance of our respective contractual obligations.
3.2 Send you information about our services (such as lesson booking confirmations) by email, SMS or any other means of communication. This processing is necessary for the performance of our respective contractual obligations and/or carried out with your consent.
3.3 Collect your payments. This processing is necessary for the performance of our respective contractual obligations.
3.4 To allow you to personalize your profile on our Platforms. This processing is carried out on the basis of your consent.
3.5 Enable you to communicate and interact with other members of our community. This processing is necessary for the performance of our respective contractual obligations and/or carried out with your consent.
3.6 Give you access and allow you to communicate with our member relations service. This processing is (i) necessary for the performance of our respective contractual obligations, (ii) carried out with your consent and/or (iii) necessary for the establishment, exercise or defense of legal claims. p>
3.7 Ensure compliance with applicable law and our terms and conditions. In the event of breaches on your part, we may suspend your account on our Platforms; This processing is (i) necessary for the performance of our respective contractual obligations, (ii) carried out with your consent and/or (iii) necessary for the establishment, exercise or defense of legal claims. p>
3.8 To send you, in accordance with the applicable legal provisions and with your consent when required by law, marketing, advertising and promotional messages and information relating to the use of our services, booking methods, or to suggest and advise you of goods or services that may be of interest to you. We are also likely to use your data to send you advertising messages that may be of interest to you on social media platforms or third-party sites. If you would like more information on this subject, we invite you to read the contractual documents of these platforms. This processing is based on your consent and/or our legitimate interest (providing you with relevant information).
3.9 To notify you of changes to our services. This processing is necessary for (i) the performance of our respective contractual obligations, (ii) compliance with our legal obligations and/or (iii) the establishment, exercise or defense of legal claims.< /p>
3.10 Manage our Platforms and perform internal technical operations in the context of problem solving, data analysis, testing, research, analysis, studies and surveys. This processing is based on our legitimate interest (ensuring the security of our Platforms and improving their characteristics).
3.11 Improve and optimize our Platforms, in particular to ensure that the display of our content is adapted to your device. This processing is based on our legitimate interest (providing you with relevant content).
3.12 To allow you to use the interactive features of our services if you wish. This processing is necessary for the performance of our respective contractual obligations and/or carried out with your consent.

4. Who are the recipients of the information we collect and why do we send them this information?
4.1. As part of the use of our services, some of your information is transmitted to other members of our community, through your public profile or as part of the reservation process (for example, we communicate your telephone number to the people with whom you wished to have lessons).
4.2. We also work closely with third-party companies that may have access to your Personal Data, and in particular with:
social media platforms that can offer you features allowing you to integrate information from your account on their own platform into your Superprof profile;
the subcontractors we use for technical services, payment services, identity verification or analytical solution providers.
4.3. We do not share your data with the third parties mentioned in 4.2. above only in the following cases:
4.4.1. When we use a service provider in connection with the performance of any contract between you and us or in order to provide or improve our services (for example, in the context of payments made via our Platforms);
4.4.2. As part of the reservation process, we are required, in order to provide the requested services, to display on our Platforms or to transmit to another member some of your Personal Data such as your first name, photograph, mobile phone number or email address. -mail;
4.4.3. We publish the reviews you write as part of our review system on our Platforms. These notices, which contain your first name and your photograph, are visible to all visitors to our Platforms;
4.4.4. When we use search engine and analytics providers to improve and optimize our Platforms;
4.4.5. When you expressly request it (for example, when you use the authentication methods provided by social networks), subscribe to a service provided by one of our partners, ask to benefit from an offer or a good plan from one of our partners);
4.4.6. When we have a legal obligation to do so or if we believe in good faith that it is necessary to (i) respond to any claim against Superprof, (ii) comply with any legal request, (iii) make to carry out any contract concluded with our members, such as the General Conditions of Use (iv) in the event of an emergency involving public health or the physical integrity of a person, (v) within the framework of investigations and investigations, or (vi) in order to guarantee the rights, property and safety of Superprof, its members and more generally any third party;
4.4.7. In the event that we sell or acquire a business or assets, in which case we reserve the right to share your Personal Data with the potential seller or buyer of this business or these assets.
4.4.8. If Superprof or all or part of its assets are acquired by a third party, the data in our possession will, if necessary, be transferred to the new owner.
4.4.9. In accordance with applicable law and with your consent when required, we may aggregate data that concerns you and that we receive or send to our business partners, including all or part of your Personal Data and information collected through of cookies. This aggregated information will only be used for the purposes described above.
4.4.10. We draw your attention to the fact that if you decide to allow us to access some of your information, in particular your Personal Data, through connection services made available by our business partners, their privacy policies are also opposable. We have no control over the collection or processing of your data implemented by our business partners on their own platform.
4.4.11 You authorize us to use your name, profile picture, content in connection with commercial, sponsored or associated content that we distribute or promote.
4.5 You can delete your account directly from your dashboard in the profile section or write to us at hello@superprof.com so that a member of our team can delete your account. We do not store any data from deleted accounts in our back office.
We do not pass on your content or information for resale to any third party company.
5. How do we use and moderate your messages?
5.1. We may review, scan, or analyse the messages you exchange with other members of our community through our Platforms for fraud prevention, service improvement, customer support purposes, enforcement of the contracts entered into with our members (such as our Terms and Conditions). For example, in order to prevent the circumventing of our online search engine, we may scan and analyse messages sent through our Platforms to check that they do not include any contact details or references to other websites.
5.2. We will never scan or analyse your messages with other members of our community for commercial and advertising purposes. We may use automated methods to carry out the moderation of these messages, but no automated individual decision-making is performed in this regard.
6. Targeted ads on social media platforms and our communications sent by e-mail and/or text messages
In accordance with applicable laws and where required with your consent, we may use the information you give us on our Platforms for electronic direct marketing purposes (e.g. (i) receiving our newsletters, invitations to our events or other communications that we think may interest you or (ii) serving you with targeted advertising on social media platforms or third parties websites).
For electronic marketing communications: You can withdraw your consent at any time by (i) unticking the relevant box in your member account, (ii) clicking on the unsubscribe link we provide in each Superprof communication sent to your attention or (iii) contacting us using the contact details provided in section 12 below.
For targeted ads and content:
on social media (e.g. Facebook and X): you can object at any time by configuring your settings regarding advertisement via your social media account;
7. Is your Information being transferred? How and where?
In principle, we store the Personal Data that we hold about you in the European Union (“EU“). However, since for example some of our service providers are based in countries outside of the European Union (“third countries”), we also transfer some of your data to third countries. This may include third countries where the European Commission has not taken the decision that such third country ensures an adequate level of protection (for example the United States). In that case, we ensure that the transfer is performed in accordance with the applicable legislation and that appropriate safeguards have been put in place (especially standard contractual clauses as issued by the European Commission) in order to guarantee a sufficient level of protection of individuals’ private life and fundamental rights.
By sending a request to the Group Data Protection Officer ( dpo@superprof.com ), we can provide you with the details regarding such appropriate safeguards (for example, the standard contractual clauses issued by the European Commission).
8. What are your rights in respect of your personal data?
8.1. You are entitled to receive a copy of your personal data that is in our possession (your right of data access).
8.2 You may request the deletion of personal data or the correction of inaccurate personal data (your right to erasure and rectification). Please note that we may keep certain information concerning you, as required by law, or when we have a legal basis to do so (e.g., our legitimate interest to keep the platform safe and secure for other users).
8.3 You have the right to object at any time (i) to the processing of your personal data for the purpose of direct marketing, or (ii) to the processing of your personal data for other purposes on grounds relating to your particular situation (your right to object to processing). Please note that in the latter case, this right only applies if the processing of your personal data is based on our legitimate interest.
8.4 You have the right to restrict the processing of your personal data (your right to restriction of processing). Please note that this only applies if (i) you contested the accuracy of your personal data and we are verifying the accuracy of the personal data, (ii) you exercised your right to object and we are still considering, as foreseen by the applicable law, whether our legitimate grounds to process your personal data in that case override your interests, rights and freedoms; or (iii) your personal data has been processed by us in an unlawful way but you either oppose the erasure of the personal data or want us to keep your personal data in order to establish, exercise or defend a legal claim.
8.5 You have the right to receive and/or have us transfer to another data controller a subset of personal data, that concern you and that you provided us with, and which we process for the performance of our contract or because you previously consented to it, in a structured, commonly used and machine-readable format (your right to data portability).
8.6 To exercise your rights, please contact the Group Data Protection Officer (see under Article 12).
8.7.You also have the right to make a complaint to the relevant data protection supervisory authority or to seek a remedy through the courts if you believe that your rights have been breached.
9. Confidentiality of your password
Where you have chosen a password which enables you to access certain parts of our Platforms, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.
10. Links to other websites and social media
Our Platforms may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy practices and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any Personal Data to these websites.

III - Right of withdrawal
Once contact details have been exchanged between you and a tutor, it is no longer possible to cancel your lesson request and you acknowledge that your right of withdrawal has been waived. Superprof will not be able to refund the student pass in this situation.
